GENERAL TERMS AND CONDITIONS FOR PRIZE PROMOTIONS
The Promotion is organized by Tommy Hilfiger Europe B.V. a private limited liability company construed under the laws of the Netherlands (the “Promoter”) and will be governed by these terms and conditions (the “General Terms”) and the additional terms for the specific promotion (“Promotion Terms”), together the “Terms”.

Participation criteria | To enter the Promotion, Participants have to: Be a resident of one of the regions (Great Britain, the Netherlands, France, Germany or Italy); Be a Tommy Together member; and Reply to the Shop to Win email campaign with a creative photo submission of the participant wearing the Tommy Hilfiger Oxford Shirt to compete in the promotional contest By sending in your creative photo submission, participants automatically accept the Terms & Conditions and Privacy Notice of the Shop to Win email campaign to be eligible to win the prize. In order to qualify in the promotional contest, the photo submission cannot be professionally photographed, nor can it include any other people, branded products, controversial content or links to products on the PVH website. |

Selection of winner | The Winner will be selected by a jury, consisting out of Tommy Hilfiger company representatives, whom will be reviewing the photo submissions and select the five winning submissions. Winning photo submissions can be featured via Tommy Hilfiger marketing channels including but not limited to the Tommy.com website, Social Media Channels and email marketing campaigns. The Tommy Hilfiger team holds the right to edit winning photo submissions before publishing on marketing channels for display purposes only, e.g. crop it to make it fit in a particular communication. |
GENERAL TERMS AND CONDITIONS FOR PRIZE PROMOTIONS
1. The Promotion is organized by Tommy Hilfiger Europe B.V., a private limited liability company construed under the laws of the Netherlands, for the respective Regions of the United Kingdom, France, Germany and the Netherlands, and PVH Italia SRL, a private limited liability company construed under the laws of Italy, for the Region of Italy (the “Promoter(s)”) and will be governed by these terms and conditions (the “General Terms”) and the additional terms for the specific promotion (“Promotion Terms”), together the “Terms”.
2. A consumer entering the Promotion (hereinafter called “Participant”) agrees to have read and understood the Terms and will be bound by them. The Promotion Terms shall prevail over the General Terms.
3. The Promotion will run in the Region specified in the Promotion Terms. The Promotion shall be void where or in as far as prohibited or restricted by law.
4. By participating in this Promotion during the Promotional Period, Participants have a chance to win the Prize. The Promotional Period, the Prize and its value is further specified in the Promotion Terms. The prize award is non-transferable and no cash redemption or prize substitution allowed, except at Promoter’s sole discretion or as provided herein and only if allowed under local laws. No cash alternatives for the Prize will be offered. If due to circumstances beyond the Promoter’s control the Promoter is unable to provide the Prize or any part of it, the Promoter reserves the right to award a substitute prize of equal or greater value.
5. In addition to the participation criteria set out in the Promotion Terms, the Participant has to enter the Promotion by agreeing to the Terms and has to be at least eighteen (18) years of age at the date of entry of the Promotion. The Promotion is not open – directly nor indirectly – to employees and immediate relatives of employees of the Promoter, its subsidiaries or affiliated companies, or any other person professionally connected to the Promotion.
6. Any Winner will be informed of the fact that they won via an email from the Promoter to the email address shared by the Participant and the names of the Winner will be published on the website that communicates the Promotion.
7. Unless otherwise stated in the Promotion Terms, the Participants will be ranked in order to select the Winner. Those who follow in the ranking, after the first name or winner, will be considered reserves in order of ranking in case of unavailability of the winners or in the absence of the required requirements. The Winner needs to respond to the Promoter within 48 hours after the first notification to confirm his/her acceptance of the prize. If such response has not been received by the Promoter within the said time, the Promoter has the right to choose another Winner applying the ranking order. The Promoter reserves the right to select an alternative winner in the event that the Promoter has reasonable grounds for believing that a selected Winner has contravened any of these Terms. Any alternative Winner will be selected applying the same criteria as that used to select the original Winner.

9. The Promoter shall not be responsible for technical errors in telecommunications networks, internet access or otherwise preventing entry to this Promotion.
10. No waiver of any rights by the Promoter or any Participant will be taken as a waiver of any other rights it may have. For example, if the Promoter waives its right to complain about a particular breach of the Terms by a Participant, it does not prevent the Promoter from complaining about other breaches.
11. Any personal data collected by Promoter from Participants (e.g. name of Winner), will be used solely in connection with this Promotion.
12. The Terms shall be solely governed by and construed in accordance with the laws of the Netherlands, unless mandatory local laws prevail and any disputes shall be subject to the exclusive jurisdiction of the competent courts in Amsterdam, the Netherlands, unless mandatory local laws prevail.
