GENERAL
The following conditions apply for all contracts, deliveries, and other services. We hereby expressly reject any contrary provisions of the contract partner. All other agreements must be confirmed by us in writing.
RIGHT TO RETURN FREE OF CHARGE
All items purchased in the Tommy Hilfiger online store may be returned to the following address free of charge within 14 days after receipt and without indication of any reasons. Excluded from returns are; underwear, swimwear, gift vouchers and perfume and make- up (unless sealed).
Please note that goods can not be returned in the Tommy Hilfiger retail stores.

Please note that the returned goods must be in a condition that corresponds to normal use for checking the goods - as is usual in conventional shops for the purpose of trying them on - and must have their original label. If the goods have deteriorated due to a more extensive use, we reserve the right to demand compensation. ORDERING
The products offered in the Tommy Hilfiger online store represent an invitation to customers to make an offer to purchase to Hilfiger Stores BV based on the data provided in the Tommy Hilfiger online store. All prices indicated are GBP amounts and include the legally prescribed value added tax. Orders and deliveries are possible only within the United Kingdom. Hilfiger reserves the right not to accept the offer if an item is not available or if you have unjustifiably failed to pay invoices for earlier deliveries. If Hilfiger is not able to execute an order, Hilfiger will inform you as quickly as possible. Orders are accepted only in quantities usual for households.
DELIVERY AND SHIPPING COSTS
As a rule, delivery time is 3 to 5 work days after processing the order. If the delivered items have obvious material or production defects, which may include transport damage, please complain to us of such defects immediately via email or by telephone. However, even if you neglect to make such complaint, your legal rights remain unaffected.
PAYMENT
You can pay for the goods by credit card (Mastercard, Visa, American Express) and by Paypal.
Hilfiger reserves the right, in case of negative results for address and credit checks, to accept only certain types of payment.
TOMMY HILFIGER GIFT CARD POLICY
1.     Purchase of Gift Cards
1.1     Tommy Hilfiger Gift Cards are available for purchase on the European Tommy Hilfiger online shops at www.tommy.com. They can only be used online on the European Tommy.com online shops.
1.2     Gift Cards are available in several designs and you can write a personalized message to go with the Gift Card. Tommy Hilfiger does not accept responsibility for the content of your personalized message and reserves the right not to include your personalized message if it is deemed inappropriate.
1.3     Gift Cards can be purchased for any value in Euros and Pounds Sterling only, with a minimum of £15/€15 and a maximum of £600 /€ 600 on the following websites: http://de.tommy.com, http://at.tommy.com, http://nl.tommy.com, http://fr.tommy.com, http://uk.tommy.com, http://es.tommy.com, http://be.tommy.com and http://eu.tommy.com .
1.4     We deliver Gift Cards free of charge using standard post. If a Gift Card is part of an order together with other Tommy Hilfiger products, please note that the Gift Card will be sent to you separately. You will be notified via email once the Gift Card has been sent to you.
           
2.     Validity of Gift Cards
2.1     The Gift Card is valid in Europe only and for a period of 24 months after its last use (use also includes balance enquiries and recharges). At the expiry of the Gift Card, any remaining balance will be cancelled and will not be reimbursed in cash or credit.
2.2     The Gift Card cannot be exchanged or returned for cash or credit, except in the countries where the law requires that the Gift Card can be cashed out. Resale of the Tommy Hilfiger Gift Card to third parties is prohibited.
2.3     Gift Cards and their use on the European tommy.com online shops are subject to the general Tommy Hilfiger online terms and conditions of purchase and use and to the privacy policy. Tommy Hilfiger reserves the right to change any of these terms and conditions from time to time without notice. You are deemed to have read the Tommy Hilfiger Gift Card policy as well as the online terms and conditions of purchase and use, which are available here or from our Customer Service Center:

2.4     This Gift Card policy as well as the general terms and conditions mentioned in clause 2.3 above may be subject to change.
           
3.     Spending your Gift Card
3.1     A Gift Card cannot be used to purchase another Gift Card.
3.2     Gift Cards can be combined with other Tommy Hilfiger online promotional offers. At this stage, only one Gift Card can be used per purchase order.
3.3     Where necessary, our systems will convert Euro card balances to Pounds Sterling or vice versa using a regularly updated exchange rate (www.oanda.com).
3.4     One Gift Card only can be redeemed against a purchase order. To use the Gift Card:
  • • Add your Tommy Hilfiger product(s) to your shopping bag.
  • • Select “CHECKOUT”.
  • • Select “Pay with a Tommy Hilfiger Gift Card” on the payment step of the checkout.
  • • Enter the 16 digit numbers on the back of the Gift Card.
  • • Scratch off the foil on the back of the Gift Card to reveal the PIN and enter this in the box marked “Gift Card PIN code”.
  • • Select “Apply” (this will allow the system to check that there is enough balance on your Gift Card to cover your order).
  • • Select the “Continue” button to proceed to the review stage before placing your order.
  • • Payment will not be processed until after you have reviewed your details, accepted the terms and conditions and selected the “Place order” button.
3.5     The total purchase order is charged against the Gift Card balance (which includes the price of the product(s), sales tax where applicable, and shipping charges). The Gift Card balance will be updated once your purchase order has been processed.
3.6     If the value of items purchased is less than the total value of the Gift Card, any unused balance shall remain on the Gift Card for future purchase orders using the same Gift Card details.
If the value of your purchase order is more than the total value of the Gift Card, you will be asked to pay the balance of the purchase order with another payment method.
3.7     Tommy Hilfiger reserves the right to refuse, cancel or hold for review purchase orders paid by Gift Cards in case of suspected fraud, cards mistakenly issued or for other violations of this Gift Card policy.
           
4.     Returns of goods paid for by Gift Card
4.1     If you return a Tommy Hilfiger product (within the timeframe as indicated in the policies of the online shop) that was paid for with a Gift Card, the Gift Card will be re-credited with the appropriate amount.
4.2     Please ensure that you keep your Gift Card following a purchase order in case you need to return a product since you will need the Gift Card number and PIN code which is displayed on the back of the Gift Card again in order to use any of the refunded amount
           
5.     Gift Card Balance
5.1     You can check your Gift Card balance at any time by clicking here. Gift Card balance may be checked with a valid Gift Card number and PIN.
5.2     Please note that at this stage, it is not possible to recharge the Gift Cards.
5.3     You can cancel your Gift Card account at any time by sending an email to service@uk.tommy.com.
           
6.     Lost or Stolen Cards
6.1     Tommy Hilfiger is not responsible and will not reimburse the Gift Card holder if a Gift Card is lost, stolen, destroyed or used without permission.
RETENTION OF OWNERSHIP
The goods remain the property of Hilfiger Stores BV until payment is made in full.
INSTRUCTIONS ON LEGAL RIGHT TO CANCELLATION
Right of return: Within two weeks, without indicating any reason, you can return the goods received by sending back the goods.
This time period begins at the earliest upon receipt of the goods. In any case, the return will be at our expense and risk.

Consequences of Return: In case of a legitimate return, any payments, goods, or services provided by either side are to be returned and compensation made for any benefits derived (e.g. benefits of use).
In case of deterioration of the goods, Hilfiger can demand compensation.
This does not apply if the deterioration of the goods is attributable only to the checking of the goods - for instance, as would be usual in a conventional shop. Otherwise, you can avoid liability to provide compensation by not using the goods like an owner and by avoiding anything that impairs their value.
DATA PRIVACY AND PROTECTION OF CREDITORS
All personal data is treated confidentially, and your rights to protection of your justified concerns are observed strictly in accordance with legal requirements.
The data needed to process the business transactions is stored and, in the course of processing the order, may be forwarded to affiliated companies or our service partners.
Beyond the purposes mentioned, we also use your data for marketing purposes, especially for the purpose of advertising Hilfiger products.
You can object to or withdraw your permission for the processing or forwarding and other use of your data for marketing purposes at any time by notifying Hilfiger: service@uk.tommy.com.
After receiving your objection or withdrawal, we will no longer use and process the affected data for marketing purposes and will cease sending further advertising media without delay.
EXCLUSION OF LIABILITY FOR EXTERNAL LINKS
If the Hilfiger pages contain links to other sites on the Internet, Hilfiger hereby declares explicitly that it has no influence on the layout or content of the linked pages. Therefore, Hilfiger dissociates itself expressly from all contents of all linked pages of third parties.
This declaration applies for all displayed links and for all contents of pages to which the links lead.
OTHER
The contractual relationship between the customer and Hilfiger shall be governed by Dutch law, excluding the United Nations Convention on the International Sales of Goods.
Promotional offers from Hilfiger are limited to one per customer, per order. Promotional offers and discounts are not applicable to gift certificates and vouchers. It is not allowed to combine offers and promotional codes together.

TERMS AND CONDITIONS FOR TOMMY HILFIGER #THROWBACKDENIM PROMOTION

1. This promotion will be governed by these terms and conditions (the “Terms”) and participants agree that they have read and understood the Terms and will be bound by them.

2. Participants may enter the promotion by sending a tweet or posting a photo on Instagram using the hashtag #THROWBACKDENIM as follows: - Tweet his/her best throwback denim photo on Twitter using the hashtag #THROWBACKDENIM; or - Post his/her best throwback denim photo on Instagram using the hashtag #THROWBACKDENIM.

3. The starting and closing date for entries is as follows per participating countries as listed in clause 4 below: April 17th, 2014 from 9 am (CET) until May 9th, 2014 11:59 pm (CET).

4. This promotion is open to residents of the European Union countries as well as for the residents of Switzerland and Russia.

5. To enter the promotion, participants have to be at least twenty-one (21) years of age at the date of entry. This promotion is not open to employees and immediate relatives of employees of Tommy Hilfiger Europe B.V. (the “Promoter”) subsidiaries or affiliated companies or any other person professionally connected with this promotion.

6. All participants shall be responsible for ensuring that their entry and/or acceptance of the prize(s) do not contravene any local laws or regulations in the country in which they are resident. This promotion shall be void where prohibited or restricted by law.

7. More than one (1) entry is allowed per Participant. Placing multiple entries is allowed but does not increase the chance of winning

9. From all entries, one (1) winner only will be chosen by the Promoter (the “Winner”) across the participating countries, based on what is determined to be the best #THROWBACKDENIM tweet or Instagram photo of all the entries.

10. The Winner will be selected within 15 business days after the last closing date as stated in clause 3 above. The Winner will be notified by email within forty-eight (48) hours after being selected. The Winner needs to respond to the Promoter within 24 hours after the first notification to confirm his/her acceptance with the terms and conditions of this Promotion, as well as with the use of his/her tweet/post and photos on the Promoter’s websites (including social media). The Winner will receive written confirmation and full details of the prize by e-mail as soon as reasonably possible thereafter. If such response has not been received by the Promoter within the said time, the Promoter has the right to choose another Winner. 11. The Winner’s prize shall comprise of:

  • • 1 return economy class flights (including taxes payable in relation to the purchase of these airplane tickets) to LAX International Airport, USA, from best international available airport where the Winner lives (to be determined by the Promoter) for the Winner and the Winner’s Guest. The Winner must travel on the dates determined by the Promoter in its sole discretion between June 1st and June 30th, 2014. The Promoter will determine the airlines
  • and flight itinerary at its sole discretion. No refund or compensation will be made in the event of cancellation or delay of any flight. Travel is subject to the terms and conditions set forth here and those set forth by the Promoter’s airline carrier of choice as detailed in the passenger ticket contract;
  • • All necessary transfers in Europe from the Winner’s city of residence to the airport of departure (and back), and from the LAX International Airport in the USA to the accommodation in Los Angeles, USA (and back);

The total approximate retail value of the prize is 5 000 dollars (five thousand). The actual value may vary based on airfare fluctuations and distance between departure and destination. The Winner will not receive difference between actual and approximate retail value.

12. The trip will only be valid between June 1st and June 30th, 2014, at a specific date to be determined later and confirmed to the Winner by the Promoter. If the Winner cannot travel during those dates, the Promoter reserves the right to select another Winner, who will be selected applying the same criteria as that used to select the original Winner.

13. The Winner’s Guests must be at least twenty-one (21) years old at the time of travel. The Winner and the Winner’s Guest must hold a passport valid for travel and any other necessary travel documentation (including, without limitation, visas or visa waivers where necessary) and are advised to obtain their own travel insurance. The Winner and the Winner’s Guest must also pay for any applicable entry fees or other similar border charges. 14. For the avoidance of doubt, the prizes do not consist of anything other than expressly set out in clause 11 above and additional costs are not included in and will be for the charge of the Winner.

15. The Winner and the Winner’s Guest are responsible for all applicable taxes and expenses not specified in the prize description.

16. The Winner and the Winner’s Guest may be required to provide a written acknowledgement of acceptance of all the terms and conditions of the promotion prior to receiving the prize.

17. In the event that the Promoter cannot for any reason not of its own fault contact the Winner within forty-eight (48) hours of first attempting to do so, the Promoter reserves the right to select another Winner, who will be selected applying the same criteria as that used to select the original Winner.

18. 23. The prize is as stated and is non-transferable. No cash alternatives will be offered. 24. 29. Only entries from individual persons will be accepted. Any entries that the Promoter believes have (a) been made via participation in a syndicate or (b) via any form of machine assisted intervention enabling computer generated multiple entries, will be disqualified.

30. No waiver of any rights by the Promoter or any entrant will be taken as a waiver of any other rights it may have. 31. These Terms shall be governed by and construed in accordance with the laws of the Netherlands and any disputes shall be subject to the non-exclusive jurisdiction of the competent courts in Amsterdam, the Netherlands.
